| 摘要： | This study took the case of mainland China vessels carrying illegal sand mining beyond boundary limits for example. In the paper, the author tried to explore the influence of the marine environmental deterioration and maritime safety from mainland China vessels carrying illegal sand mining and whether the maritime enforcement on the Kinmen-Xiamen waters is capable for combating the illegal sea sand mining by mainland boats. Based on analysis of documents, opinions from the experts, and interviews, the author majored on the marine environmental deterioration and the influence of maritime safety, and the author also tried to explore whether the maritime enforcement on the kinmen-Xiamen waters is capable for combating the illegal sea sand mining by mainland boats. Then, it found out that illegal sea sand mining in Kinmen-Xiamen waters has brought negative effects to marine environment and maritime safety. Moreover, Cross-strait cooperation is required for effective legal enforcement. In conclusion, the author suggests five ways to study on. Firstly, the need to maintain the professional image of the CGA. Secondly, the needfor a specific legislation on the enforcement. Thirdly, the need to strengthen the enforcement capacity. Fourth, the need to regional integration competence. And the last, the need to enhance the legal enforcement. |
