This digest contains a report prepared under TCRP Project J-5, "Legal Aspects of Transit and Intermodal Transportation Programs," for which the Transportation Research Board is the agency coordinating the research. The report, which has the same title as this digest and is authored by Robert A. Hirsch, presents an assessment of problems in implementing the Americans with Disabilities Act (ADA), Public Law 101-336, enacted in 1990, from the perspective of transit operators. The report should be helpful to transit operators, administrators, planners, risk managers, and attorneys in devising a transit program that meets the objective of the act, minimizes risk of harm to disabled passengers, and ultimately minimizes the transit operators' potential for tort liability. It is organized as follows: Introduction; (I) Requirements of the ADA and Predecessor Federal Laws Governing Accessible Transportation; (II) Survey - Impact of the Americans with Disabilities Act on Tort Liability; (III) Requirements Imposed on Transit Operators by the Americans with Disabilities Act (ADA); (IV) Waivers and Other Remedial Strategies; Appendix A - Survey Questionnaire; Appendix B - Responses to Survey Tables; and Appendix C - Seattle Metro Letter to U.S. DOT. |
