| 摘要： | This paper mainly provides an overview of provisions on variations in the Design and Build Model contracts. Few illustrations which describe different circumstances leading to Variation are given. As an example, the Engineer's approach in some cases is cited. It has been clarified that in a Design and Build Model Contract the variation is the right of the Engineer and the compensation in terms of additional time and cost for the said reason is the entitlement of the Contractor. Few suggestions are given for the benefit of field Engineers to reduce the disputes related to variation. It is strongly suggested that more time needs to be spent in pre-bid investigations to avoid changes after awarding of the contract. Also, the Engineer and the Client have to be more proactive in resolving the issues of variation for timely completion of the Projects. |
