| 摘要： | 1924年海牙規則第三條第四項第一段規定：「此種載貨證券，應作為依照第三項（1)、（2)及（3)等款所記載之貨物，業經運送人收受之表面證據」(Such a bill of lading shall be prima facie evidence of the receipt by the carrier of the goods as therein described in accordance with paragraph 3(a), (b) and (c))， 因此運送人所簽發之載貨證券如果是「清潔載貨證券」（clean bill of lading)，則該紙證券不過是關於貨物如同證券上所記載的「表面證據」而巳(only crears a prima facie presumption that the goods are as described on the bill of lading )(註一），尚允許運送人提出反證加以推翻。 |
