As used in this Guide, a 'boarding' is an armed intervention aboard a vessel to detect and/or suppress violations of applicable law. Readers should distinguish this term from the wide variety of unarmed USCG inspection activity that occurs daily in U.S. and foreign ports. Boarding operations are distinct from other law enforcement operations, especially shore-based operations. Federal courts have long recognized that the nature of waterborne commerce in waters providing ready access to the open sea and vessel operations on the high seas are fundamentally different from the nature of vehicular operations ashore.
