The fundamental purpose of the Joint Review is to serve as a constructive exercise that contributes to the effective operation of U.S. Customs and Border Protection's Undertakings of May 11, 2004, concerning PNR information derived from flights between the European Union and the U.S. The review conducted by the Department of Homeland Security Privacy Office regarding CBPs implementation of the Undertakings, from November 2004 through September 2005, also was conducted in this spirit. As of the date of the Joint Review, the Privacy Office finds that CBP is in compliance with representations made in the Undertakings. CBP has invested substantial time, capital, and expertise to bring its operations and procedures into compliance with the Undertakings. This is a recognizable achievement, particularly considering the state-of- the-art technology solutions that CBP voluntarily undertook to fully implement the Undertakings through the information technology (IT) systems used by CBP offices nation-wide. |
