Planning, designing, operating, and maintaining transportation facilities is a challenging undertaking. Sometimes what gets built or how it's operated misses the mark with regard to users resulting in lawsuits or claims. Many litigation cases originate with aggressive driving, traffic control device (TCD) non-compliance, and drivers whose capabilities are limited by drowsiness, inattentiveness, and/or the influence of alcohol/narcotics. Aggressive driving can be characterized by speeding, following too closely, and non-compliance by failure to obey traffic control devices by road users (e.g., vehicle drivers, cyclists, pedestrians, and micromobility users). These circumstances are among those that can commonly pivot into pursuit of recovery for damages/injuries. Because of this, traffic control devices, roadway design, and maintenance can become factors in litigation cases. This can be complicated by standards that change over time. |
