| 摘要： | Professional appointments are a common feature of many major highway projects. But what happens when things go wrong? Claims against consultants for alleged professional negligence present many unique and challenging hurdles. While it is not possible to prescribe a one size fits all' approach, failing to plan for worst case scenarios can lead to significant difficulties, or even leave claimants with nowhere to go. On major projects, the demands upon an employer or contractor may be of increasing complexity and require a party to outsource services to consultants for a range of issues. This should require the use of professional appointments, including detailed provisions concerning scope and service standards. Many of these appointments will be highly bespoke, but a range of standard forms, such as the Professional Services Contract produced by NEC are also widely used. |
