Do you remember 2019? While electronic signatures have been in use for some time now, the COVID-19 pandemic brought to light an increased ability (and indeed need) to adapt businesses to deal with issues of turning documents around quickly without having parties signing documents in the same room at the same time. This has created some legal headaches. Under English law, a person's intention can be used to determine whether or not they have entered into a binding agreement. Therefore, there can sometimes be some ambiguity as to what constitutes a signature, particularly in the context of electronic signatures where, in the absence of wet ink' signatures, intent might be harder to evidence. |
