Currently, developers pay a contribution to mitigate the impact of a development and to help create the critical infrastructure required to support communities. These contributions are designed to give the local authority the power and flexibility to direct money where it is most needed according to local priorities and demands. It is crucial to have a simple mechanism in place to collect these contributions. To address this, the Government proposed the Infrastructure Levy to simplify and enhance the funding process. The proposals seek to reform the way developer contributions are collected in England. The aim is to ensure that local authorities receive a fairer contribution from the money that typically accrues to landowners and developers, to support new infrastructure, including schools, doctors' surgeries, green spaces and transport connectivity. The Infrastructure Levy, proposed as part of the Planning White Paper in 2020 and subsequently incorporated into the Levelling Up and Regeneration Bill, aims to replace the existing Section 106 and Community Infrastructure Levy (CIL) mechanisms used to secure funding from developers. Unlike the voluntary nature of CIL, the Infrastructure Levy will be mandatory for all local authorities, ensuring a more consistent approach to funding collection. |
