摘要: Contracts have much in common with long-term relationships and Saturday night parties: there is often a temptation to leave when things aren't working out and it is very easy to get it wrong. Over the years, the courts are full of examples of errors when it comes to the termination of agreements. Termination means ending parties' rights and obligations. In highways contracts this usually means the obligation to carry out works or perform services for a contractor and the right to be paid for this. For an employer, this will be the right to receive works and services and the obligation to pay. Termination means that a contract does not necessarily cease to exist; terms may continue to operate - for example, confidentiality or dispute resolution provisions. While parties (understandably) may never want to contemplate terminating contracts, it is important to know the legal position should the end of the road come into view.
