Our company recently reviewed a marine contractor's insurance coverage. During the review, we learned that one of their employees had operated a crane aboard another contractor's barge for that contractor's project. While this occurred only rarely, it did open up a big gap in their coverage. Fortunately, there was a solution: Maritime Employers Liability (MEL). Commercial vessels carry Protection and Indemnity. P&I provides coverage for the insured's crewmembers, but this only applies to crewmem-bers who are employed by the vessel owner or operator. Employees that work on board someone else's vessel would be covered under MEL. MEL follows your employees while they are on non-owned vessels. Coverage under the policy can include: 1. Jones Act; 2. Death on the High Seas Act; 3. General maritime law of the U.S.; and 4. Maintenance, cure and wages. |
