Environmental Law-Clean Water. The United States Army Corps of Engineers did not act arbitrarily or capriciously under the Administrative Procedure Act in tailoring its National Environmental Policy Act (NEPA) analysis to address environmental effects associated with activities it permitted, namely authorizing an energy transportation company to discharge dredged and fill material into United States waters under the Clean Water Act in its construction of an oil pipeline, as opposed to environmental effects associated with operation of the pipeline; the Army Corps' environmental assessment specified that the scope of its NEPA analysis related to specific activities requiring a permit, and it did not have sufficient control and respon- sibility over the entire project to extend NEPA review to the entire pipeline construction or operation.-Red Lake Band of Chippewa Indians v.
