The district court, in a maritime negligence action, did not clearly err in allocating 45 percent of the fault to each of two tow-boats traveling downriver and 10 percent of the fault to a bulk carrier traveling upriver in connection with an allision resulting when the carrier took evasive action to avoid the towboats as they attempted an overtaking maneuver; the court correctly found that the towboats violated several Inland Navigation Rules, including Inland Rules concerning prudent seamanship, lookout, risk of collision and action to avoid collision, and there was conflicting evidence as to what the carrier could have done under the circumstances, precluding legal error in the court's apparent conclusions that the carrier did not violate some of the Inland Rules violated by the towboats.- SCF Waxier Marine LLC. v.
