These guidelines will assist transit agencies in developing drug and alcohol testing programs that comply with regulations of the Federal Transit Administration (FTA). These regulations were first published in the Federal Register on February 15, 1994, as Prevention of Prohibited Drug Use in Transit Operations (49 CFR Part 653) and Prevention of Alcohol Misuse in Transit Operations (49 CFR Part 654), and later revised and combined into one regulation (49 CFR Part 655) on August 1, 2001. These guidelines are directed to transit agencies receiving federal funding under sections 5307, 5309, and 5311 of the Federal Transit Act, and section 103(e)(4) of title 23 of the U.S. Code. In addition, these guidelines will assist state agencies that receive FTA funding and contractors who perform safety-sensitive services for transit agencies. These guidelines provide a comprehensive, up-to-date summary of the regulatory requirements, incorporating into one publication all of the guidance the FTA has issued over the past several years including technical assistance, letters of interpretation, audit findings, newsletters, training classes, and public speaking engagements. |
