There is no available measurement of weight limit compliance sufficiently comprehensive to
permit determination of actual penalty effectiveness within different States. The approach used
for this study was to conduct discussions with enforcement officials in nine States - diversified
by geography, fine severity, roadside enforcement practice and adjudication system — on
whether their penalty imposition is considered to be effective. The basic question of whether
State penalization is inducing satisfactory operator compliance behavior could not be answered
definitively. However, the enforcement authorities commonly considered that there are
persistent compliance problems < mi secondary roads and in local bulk trucking. This suggests the
potential value of enforcement efforts targeted at these sectors, which arc not amenable to
economical surveillance by permanent, fixed-site weigh stations. One promising approach
appears to be expansion of the practice, already noted as being underway in three of the nine
Study States, of analyzing data output from their “ non-enforcement" weigh-in-motion equipment
