| 摘要： | The absense of an explicit warranty clause in the contract wording hypothetically eliminates the contractors' accountability of any future defects in their work. One- or two-year guarantees are not rare in bridge paint specifications today, although the guarantees are often vague and poorly written (Hare, 1990.) Few guarantees are properly written or legally binding. A proper guarantee not only offers the Department of Transportation advantage in the improved quality assurance but also allows methodologies other than low prices in evaluating bids. It may also assist in eliminating the less competent contractors from entering the bid. This report represents a study conducted to investigate the practices of using warranty clauses in steel bridge painting contracts. The ultimate goal of the study is to draft a warranty clause that can be put into experimental use in INDOT's 1997 construction-season. The proposed warranty clause will act as an experimental form to be used on one pilot project. It will be subject to further analysis and modifications according to its performance in the pilot project. |
