Any refiner or importer planning to produce or import highway diesel fuel in 2006-10, is required to submit to the U.S. Environmental Protection Agency (EPA or the Agency) pre-compliance reports. These reports are due annually from June 2003 through 2005. They must contain estimates of the volumes of 15 parts-per-million (ppm) sulfur highway diesel fuel and 500 ppm sulfur diesel fuel that will be produced at each refinery or imported by each importer from June 2006 through May 2010. For those refineries planning to participate in the credit trading program, the reports must contain a projection of how many credits will be generated or used by each refinery. The pre-compliance reports must also contain information outlining each refinery's timeline for compliance with the 15 ppm sulfur standard and provide information regarding engineering plans (e.g., design and construction), the status of obtaining any necessary permits, and capital commitments for making the necessary modifications to produce 15 ppm sulfur highway diesel fuel. In general, the reports for 2003 indicate that (1) the industry is on target for complying with the 15 ppm sulfur standard on time, (2) highway diesel fuel production will be sufficient to meet demand, and (3) 15 ppm sulfur diesel fuel will be widely available nationwide. |
